PRESIDENTIAL DECREE

AS THE CENTRAL MARTIAL LAW ADMINISTRATOR

NO. 43 YEAR 2003

ON THE REGULATION OF FOREIGNERS, NON GOVERNMENTAL ORGANISATIONS AND JOURNALISTS IN THE PROVINCE OF
NANGGROE ACEH DARUSSALAM

THE PRESIDENT OF THE REPUBLIC OF INDONESIA

Considering:
That for the sake of public safety, public order, and security matters, during the State of Emergency with the status of Martial Law in the Province of Nanggroe Aceh Darussalam, it is deemed necessary for the president as the chief authority of the military state emergency to stipulate a Decree on the Regulation of Activities for Foreigners, Non-Government Organizations and Journalists in the said territory;
In view of: 1.
Article 4 verse (1), Article 10 and Article 12 of the 1945 Constitution, as already amended by the Fourth Amendment to the 1945 Constitution;
2.
Law No. 23 Prp/1959 on a State of Emergency (The State Gazette year 1959 No. 139, Supplement to the State Gazette No. 1908) as already amended twice, the latest by Law No. 52 Prp/1960 (the State Gazette Year 1960 No. 170, Supplement to the State Gazette No. 2113);
3. The Presidential Decree No. 28/2003 on The Declaration of a State of Emergency with the Status of Martial Law in Nanggroe Aceh Darussalam Province (State Gazette Year 2003 No. 54);

DECIDED:

 

To stipulate:

A PRESIDENTIAL DECREE ON THE REGULATION OF ACTIVITIES FOR FOREIGNERS, NON-GOVERNMENT ORGANIZATION IN THE PROVINCE OF NANGGROE ACEH DARUSSALAM IN THE STATE OF EMERGENCY WITH THE STATUS OF MARTIAL LAW.

 

Article 1

 

1.
During the State of Emergency with the status of Martial Law in the province of Nanggroe Aceh Darussalam, foreigners are not allowed to have tourist visits and do any activities against the aims of the State of Emergency in the said territory.
2.
For the success of the integrated operation in the State of Emergency with the status of Martial Law in the said territory, foreigners are allowed to visit or do activities with the permission of the Minister of Justice and Human Rights on behalf of the President as the Central Martial Law Administrator.
3.
Foreigners who are under a working contract or another agreement with the government of the Republic of Indonesia should report their acticivity (ies) in the said territory to the Regional Martial Law Administrator.

Article 2

Non Government Organizations, both overseas as well as Indonesian, are not allowed to carry out any activity against the aims of the State of Emergency with the status of Martial Law in the said territory.

Any humanitarian aid coming from the other countries, World Organizations, and Non Government Organizations, both foreign as well as national, in the Province of Nanggroe Aceh Darussalam is coordinated by the Coordinating Minister for Public Welfare on behalf of the President as the Central Martial Law Administrator.

The provision of the humanitarian aid as mentioned in verse (2) will be adjusted to the humanitarian scheme carried out by the Regional Martial Law Administrator.

Article 3

Journalistic activities by foreign journalists and foreign media correspondents in the Province of Nanggroe Aceh Darussalam can be selectively carried out with the permission of the Minister of Foreign Affairs on behalf of the President as the Central Martial Law Administrator.

A journalistic activity in the said territory by a national journalist working for a national media can be done with a written permission from the Regional Martial Law Administrator.

Any risk and consequence from a journalistic activity done by both foreign and national journalists is to be their own responsibility.

Pasal 4

 

This Presidential Decree shall take effect on the date it is promulgated. For public knowledge, this Presidential Decree shall be published in the State Gazette of the Republic of Indonesia.
