International Court of Justice Advisory
Opinion on
the Construction of a Wall by Israel in the Occupied
Palestinian Territory

The Indonesian Government welcomes
and supports the International Court of Justice Advisory
Opinion on the construction of a Wall in the Occupied Palestinian
Territory issued in Den Haag on July 9, 2004. The Advisory
Opinion emphasizes that the construction of the Wall by
Israel is illegal as it is contrary to international law,
and thus should be ended and dismantled. The Advisory opinion
also stresses that Israel is under a legal obligation to
make reparation for the damage arising from the construction
of the Wall.

The International
Advisory Court has conducted both written and oral
proceedings in order to obtain information and legal
opinions from member States of the UN and numerous international
organizations concerning the issue. In line with the constitutional
mandate as well as commitment to consistently defending
the struggle of the Palestinian people, the Indonesian Government
has actively participated in every step of addressing the
issue (both written and oral proceedings)
by the International Court of Justice. Indonesia underlines
that the construction of the Wall is in contravention to
the principles of international law, in particular humanitarian
and human rights laws. Indonesia resolutely rejects the
argument of the Israeli Government, which is pointless and
disproportional, asserting that the construction of the
Wall was carried out for the sake of selfdefence. |

During the written proceeding,
there were 44 member States of the UN and two international
organizations, namely the Arab League and the Organization
of Islamic Conference (OIC), transmitting written statements
concerning the issue. During the oral proceeding that was
summoned on February 23 - 25, 2004, representatives of 13
member States of the UN as well as the Arab League and the
OIC made oral statements conveying their legal opinions
with regard to the construction of the Wall. |

The Indonesian Government
reiterates its support for peace efforts based on Security
Council resolutions 242 (1967) and 338 (1973), and on the
fundamental principle of land for peace. Indonesia
also reiterates its support for the vision of two State:
Palestine and Israel, living side by side peacefully as
encapsulated in various relevant Security Council resolutions. |
